Most of us believe that we are fair-minded individuals, open and non-judgmental about social categories and values. Overwhelming scientific evidence reveals, however, that daily decisions in our personal and professional lives are impacted by unconscious bias, which often involves issues of race, gender, religion, income, sexual identity, home status and numerous other societal groups. This legal ethics briefing addresses the social science around implicit bias, providing examples of how it affects our lives, the circumstances under which bias is most likely to surface and strategies to combat such tendencies, both personally and professionally. BARRY E. LEWIN with the Law Office of Barry E. Lewin has been a trial lawyer for almost 35 years. His practice areas include personal injury, education law, premises liability, wrongful death, medical malpractice and traumatic brain injury. Mr. Lewin was appointed to be a judge pro tempore by the judges of Maricopa County Superior Court. The time spent as a court appointed judge pro tempore, compliments the hundreds of settlements Mr. Lewin has obtained for clients on both sides of cases. It also allowed him to mediate and settle numerous cases without trial. He has taught trial practice, evidence, and legal medicine to lawyers, paralegals and nurse consultants. He has also taught advanced deposition techniques as a faculty member of the National Institute of Trial Advocacy. For the last several years, Mr. Lewin has served as a faculty member for the State Bar of Arizona Trial College. He is a member of American Board of Trial Advocates, Arizona Association for Justice, State Bar of Arizona (certified specialist in personal injury and wrongful death litigation), Arizona’s Finest Lawyers (founding member), Million Dollar Advocates Forum, National Trial Lawyers (Top 100 Lawyers) and Southwest Super Lawyers. Mr. Lewin received his B.A. degree, cum laude, from Occidental College and earned his J.D. degree, with distinction, from the University of Arizona College of Law.
