JENNIFER PENBERTHY BUCKLEY is an employment law attorney with Potter Anderson & Corroon LLP. Her practice focuses on employment counseling and litigation. She advises employers on adopting and implementing effective policies consistent with federal and state law; responding to employee requests for leave and accommodation; avoiding and responding to discrimination claims; and more. Her employee benefits practice includes drafting plan documents for welfare benefit plans, deferred compensation and executive compensation plans, and Section 125 or “cafeteria” plans. Ms. Buckley counsels employers in drafting and negotiating enforceable employment agreements, restrictive covenants, retention agreements, and separation agreements. She represents employers in proceedings before the Delaware Department of Labor (including the Unemployment Insurance Appeal Board), the EEOC, and Delaware federal and state courts. Ms. Buckley earned her B.A. degree from Salem College and her J.D. degree, summa cum laude and valedictorian, from Widener University Delaware Law School. She serves as secretary to the Labor & Employment Section of the Delaware State Bar Association and is a member of the American Bar Association.
ASHLEY LEBRUN is an attorney with Archer & Greiner P.C. Ms. LeBrun works with the firm's labor and employment and trade secrets groups. She counsels employers and represents them in litigation. Ms. LeBrun drafts and revises employee handbooks and policies, advises employers on how to handle requests for leave and reasonable accommodations, investigates employee claims, and guides employers on terminations and on FLSA overtime issues and exemptions. Counseling also includes drafting and negotiating severances as well as restrictive covenants, such as non-competition, non-solicitation, and non-disclosure agreements. She defends employers facing claims for violating the New Jersey Law Against Discrimination (NJLAD), the New Jersey Conscientious Employee Protection Act (CEPA), the New Jersey Family Leave Act (NJFLA), the Pennsylvania Human Relations Act (PHRA), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Family and Medical Leave Act (FMLA), and Title VII of the Civil Rights Act. Ms. LeBrun earned her B.A. degree, summa cum laude, from Rutgers University and her J.D. degree, magna cum laude, from Seton Hall University School of Law.
