List three types of exempt assets. 3. Explain how irrevocable trusts fit into Medicaid planning. 4. Distinguish between ethical and unethical practices. 5. AVERY J. MAYNE is an attorney with Walny Legal Group LLC, where she concentrates her practice on family law, elder law and estate planning; and works with clients to resolve a variety of legal concerns pertaining to divorce, adult guardianships and special needs planning. She also focuses on public benefit planning, including Medicaid (Title XIX) asset planning and planning for individuals with long-term care needs. Ms. Mayne is a certified mediator and a certified adult guardian ad litem. She is a member of the Association for Women Lawyers, the Collaborative Family Law Council of Wisconsin, and she sits as the co-chair of the Milwaukee Bar Association’s Alternative Dispute Resolution Section. Ms. Mayne earned her B.A. degree, with honors, from the University of Missouri; and her J.D. degree from Marquette University Law School, along with a certificate in alternative dispute resolution.
THOMAS J. MURPHY is an attorney located in the Ahwatukee area of Phoenix. His practice emphasizes estate planning, elder law (including nursing home issues), all probate matters (including contested matters and guardianships), and tax controversies. Mr. Murphy has regularly appeared before the Arizona Court of Appeals, litigating many of the cutting-edge appellate cases in probate law and has successfully litigated cases in the U.S. Tax Court, the Arizona Tax Court, and the Arizona Board of Tax Appeals. He is a member of the National Academy of Elder Law Attorneys, the State Bar of Arizona (Tax Law, Probate and Trust Law, Mental Health, and Elder Law sections), and the Arizona Medicaid Planning Council. He serves on the Advisory Board of the Phoenix Tax Workshop and the Editorial Board of NAELA News. Mr. Murphy graduated from Tufts University, with honors, and he earned his J.D. degree from Suffolk University Law School.
