Millions of prescription medications are filled in the United States each day and in 2018 alone, a reported 5.8 billion prescriptions were dispensed. And despite lifesaving improvements in therapeutics and technology, medication errors continue to occur, which can result in significant patient harm or death.
In the context of litigation, attorneys must be able to identify and analyze the full spectrum of errors that can arise from initial prescription through medication dispensing. Common mistakes include dosage, filling, and labeling errors, and failure to identify, manage, or monitor warnings and contraindications. Awards and settlements in prescription error cases are often high, and the stakes can be extreme for attorneys arguing negligence, harm, and causation.

DR. BURTON BENTLEY II, M.D., FAAEM, is a board-certified Emergency Medicine physician and a nationally recognized authority on medical liability, informed consent, and complex issues at the intersections of Medicine, Business & Law. As CEO of Elite Medical Experts, Dr. Bentley and his team have consulted on over 8000 medicolegal matters totaling over $3B at risk. Dr. Bentley secured a Bachelor of Science in Biochemistry as a Phi Beta Kappa graduate of the University of Arizona before earning his medical degree at the same institution where he was awarded Alpha Omega Alpha before graduating at the top of his class. Dr. Bentley then completed a residency in Emergency Medicine at the Medical College of Wisconsin where he served as a flight physician on nearly 100 emergency missions. He then practiced full-time Emergency Medicine as a Partner at Northwest Tucson Emergency Physicians for 21 years before stepping out to pursue a novel medical device that he patented and commercialized in 2016. Throughout his entre clinical career, Dr. Bentley consulted on complex medicolegal issues, and in 2010 he founded Elite Medical Experts, a consulting firm that aligns Professors of Medicine and Surgery as consulting and testifying experts in complex litigation. Elite serves over 4000 clients across the United States including law firms, governmental entities, corporate entities, and insurers. Dr. Bentley lectures extensively on medicolegal topics and consults strategically on medical negligence, informed consent, risk mitigation, and crisis management at the clinical practice level. More recently, Dr. Bentley co-founded Consent Spectrum, a digital platform to optimize informed consent for nearly every aesthetic medical procedure.
DR. LUKE PROBST, PharmD, BCPS, is the Director of Pharmacy at Upstate University Hospital Downtown Campus in Syracuse, New York, where he also serves on the Medication Safety Committee and as Vice-Chairman for the Institutional Review Board. Over the course of a 35-year career, He has been directly responsible for clinical and operational pharmacy services in a variety of inpatient, ambulatory, retail, and pediatric settings including three academic medical centers. Dr. Probst secured a B.S. degree in Pharmacy from Albany College of Pharmacy followed by a Doctor of Pharmacy degree from Shenandoah University. He was then granted board certification as a Pharmacotherapy Specialist by the Board of Pharmaceutical Specialties. Dr. Probst has published 10 peer-reviewed articles and has been an invited lecturer on numerous occasions. He is also a member of the Central New York Society of Health-System Pharmacists and the American College of Clinical Pharmacy. As managing partner of Forensic Pharmacy Experts, Dr. Probst is a recognized expert in matters involving medication prescription, administration, and dispensing. His training and experience inform the application of a pharmacologic basis to pharmacy practice, management decisions, and consultation.
CHRISTIAN D. SEARCY SR., Esq., is the President and CEO of Searcy Denney Scarola Barnhart & Shipley, a 31-lawyer law firm with over 100 personnel and a main office in West Palm Beach, Florida. For the past 46 years, Chris Searcy has litigated cases involving catastrophic injury and wrongful death throughout the State of Florida and other states as well. In 1977, at age 29, he became the youngest lawyer in the United States to achieve a $1 million dollar verdict for a single personal injury case. Since that time, he has had numerous multi-million-dollar verdicts including four 8-figure jury trial verdicts in 2007 totaling over $100 million. After earning a B.A. with distinction from the University of Virginia, Mr. Searcy received his Juris Doctorate from Stetson University College of Law, graduating in the top 10% of his class. He was admitted to The Florida Bar on May 1, 1973, and practices in all Florida State Courts and U.S. District Courts in Florida, as well as the Eleventh Circuit Court of Appeals and the United States Supreme Court. He is Board Certified in Civil Litigation by the National Board of Legal Specialty Certification (formerly the National Board of Trial Advocacy) and Board Certified in Civil Litigation by The Florida Bar Association. He has been selected for inclusion in The Best Lawyers in America in every edition since its inception 30 years ago, and was ranked as the #1 Lawyer in Florida in the 2013 Florida Super Lawyers Nomination, Research and Blue Ribbon Review Process. He is listed as one of the "Legal Elite" in Florida Trend magazine, named as one of the top lawyers in South Florida Legal Guide, and selected one of Lawdragon's 500 Leading Lawyers in America "Hall of Fame." Chris Searcy received the highest honor of the Florida Justice Association in 2005 when it bestowed him with the Perry Nichols Award in recognition of a lifetime of outstanding service to the cause of justice. He was the first recipient of the Florida Justice Association's Compassionate Gladiator Award in 2006, and received the Al J. Cone Lifetime Achievement Award by the Florida Justice Association in 1997. In 2006, Chris Searcy was one of two lawyers in the country to receive the "Warhorse Award" from the Southern Trial Lawyers Association honoring his outstanding skill as a trial advocate and his extraordinary contributions to the cause of justice. Mr. Searcy's Bar work and community service include: Chairman of the Rules of Civil Procedure Committee of The Florida Bar; Chairman of the Judicial Administration Committee of The Florida Bar; Chairman of the Standing Committee on Professionalism of The Florida Bar; Code and Rules of Evidence Committee of The Florida Bar; Emeritus Member of the Board of Overseers of Stetson University College of Law; Emeritus Member of the Board of Directors of the College Foundation of the University of Virginia, University of Virginia Jefferson Scholars Regional Selection Committee for Palm Beach and is a member of the Alumni Association of the University of Virginia Board of Managers. He is the Past President of The Florida Supreme Court Historical Society and serves on its Board of Trustees and Oral History Committee. He has served on the Judicial Nominating Commission for the United States District Court of the Southern District of Florida and the Middle District of Florida. From a community perspective, Chris Searcy's personal philosophy of advocacy for those in need has made its mark on South Florida, where he and his firm support numerous non-profit organizations committed to helping the disabled, improving education, and advancing community causes.
