Separating Coincidence from Causation in Work-Related Cancer
Dr. Tom Fariss, physician consultant and occupational medicine specialist, joins trial attorneys William Gavin and Andy Vickery to explore one of the most pressing medicolegal issues of our time: the relationship between work-related exposures and cancer. This 90-minute CLE begins with background information about cancer and exposure-related cancer causation followed by an overview of the factors to consider when distinguishing correlation from causation. Topics include general and specific causation, cancer clusters, occupational cancer, environmental cancer, common flaws and mistakes in causation determinations, and the general concepts of investigation, analysis, and causation that emerge during legal disputes. Mr. Gavin will demonstrate key points as they applied to a recent Federal Employers Liability Act (FELA) claim where he proved a causal link between chemical exposure and throat cancer. Mr. Vickery will then address Daubert challenges in light of the Bradford-Hill criteria for causation. Plaintiff and defense perspectives will be equally considered, and time for questions will be allotted at the end of the live event. Register today!
