"Top 10 Questions to Ask Yourself to Keep Compliant in Real Estate Transactions"

Ask yourself these questions before preparing real estate transactional documents to ensure they are in conformance with local recording requirements.
By keeping these thoughts in mind you can avoid a rejection of documents for recording:
  1. Did you collect the proper transfer tax and do you have the proper transfer tax form?
  2. Do you need your legal description approved?
  3. Is the format of your document correct?
    (Consider paper weight, size of type, print style, title to each document and margins).
  4. Do you have the proper recording fees?
    (Without a doubt, this is the primary reason documents are rejected).
  5. Is the acknowledgement properly done?
    (The name on the seal and signature must match the expiration date of notary public shown and the seal or stamp must be legible).
  6. Did the proper parties sign the document?
    (In some jurisdictions both the grantor and grantee must sign the deed).
  7. Are you actually recording the document in the correct county?
  8. Does your legal description meet local transfer and conveyance standards?
  9. Do the documents contain the proper information?
    •  Legal Description
    •  Witnesses
    •  Signatures
    •  Addresses
    •  Prior References
    •  “Prepared By” Statement
    •  Proper Margins for Recorder's Stamp
  10. Is your document illegible?
    •  The recording office may require a name to be typed or printed under the actual signature.
    •  Will local rules or state statutes deem your document illegible?
    •  The recording office may require a particular color of ink to be used for signatures.
Rob Roesch II, serves as commercial underwriting counsel with Chicago Title. Mr. Roesch joined the company in August 2003 following six years with a local title agency, where he was senior underwriting counsel in the commercial division and managed their title operations. He earned his B.S. degree from Muskingum College and J.D. degree from Capital University Law School. Mr. Roesch advises the company on legal and business affairs in several roles. His current and past responsibilities include title underwriting and commercial and residential transactional counsel. Mr. Roesch has spoken for boards of realtors and local realty companies on title and real estate matters. He is a member of the Columbus Bar Association (member, Real Property Section) and Ohio State Bar Association.

We've all come to rely on fast and efficient websites to obtain basic information for our real estate transactions, especially in the commercial real estate arena. Below are a few websites that may be of some assistance to you.
  • State and Local Government on the Net
    This website offers one-stop access to the websites of thousands of state agencies and city and county governments.
  • Coordinated Legal Technologies
    This is a great site to do corporate searches on. It offers a compilation of links for quick access to the corporate information available in online searchable databases maintained by the Secretary of State for any given state.
  • National Title Information
    Offers state by state information for title insurance forms, title insurance endorsements, recording requirements, transfer tax, local customs for who typically pays recordings fees, conveyance taxes, proper document execution requirements and much more (Requires a password and username for new users).
