ROBERT A. BATTLES is of counsel with Lane Powell.PC. He represents both individuals and business clients in regulatory and complex litigation matters including Washington Industrial Safety and Health Act (WISHA) and industrial insurance defense. Mr. Battles was with the Washington State Attorney General's Office for 10 years and represented the Department of Labor and Industries in all aspects of litigation, mediation, contract negotiation, public disclosure, document retention and confidentiality issues. During that time, he also served as the legal advisor to the WISHA and Building Trades Program (Electrical, Contractor, Plumber, Elevator, Boiler and Factory Assembled Structure Sections). Mr. Battles has drafted legislation and administrative codes as well as prepared inter-local and inter-agency agreements including confidentiality and conflict issues between state agencies. He has litigated cases at all levels of the Washington state courts, Federal District Court, the Ninth Circuit Court of Appeals and administrative tribunals such as the Board of Industrial Insurance Appeals. Mr. Battles also has extensive experience representing clients before state and federal regulatory agencies including the Washington State Department of Financial Institutions, Washington State Employment Security Department and the Washington State Department of Labor and Industries. He has previously written articles in his main areas of practice. Mr. Battles is a member of Bates Technical College Steam Certification Board (chair). He earned his B.A. degree from Gonzaga University and his J.D. degree, cum laude, from Gonzaga University School of Law. DOUGLAS B. EHLKE is an attorney in Federal Way, Washington. He has successfully defended employers throughout the United States against invalid Federal and State OSHA citations and against proposed penalties exceeding $1 million. A number of Mr. Ehlke's cases have established precedents in the doctrines of Fair Notice, Estoppel, Unpreventable Employee Misconduct, Search Warrant Inspection Selection, and Infeasibility. He also has defended against criminal Cal-OSHA charges, nearly 1000 alleged willful citations, and jury trial intentional workplace tort charges. In 1988, Mr. Ehlke received a Presidential Appointment to the Federal Occupational Safety and Health Review Commission. In 1989, he was board-certified by the American Board of Trial Advocacy in civil trial advocacy. Mr. Ehlke is a member of the American College of Legal Medicine. He has taught as an adjunct professor of law at the University of Washington School of Law and University of Puget Sound School of Law. Mr. Ehlke also served as a Rule 39 Mediator for U.S. Federal District Court and a member of the American Arbitration Association. He is a member of the Washington State Trial Lawyers Association, Washington State Bar Association, Minnesota State Bar and the American Trial Lawyers Association. Mr. Ehlke is admitted to practice before the U.S. District Court-Western District of Washington; U.S. District Court-Eastern District of Washington; U.S. Court of Appeals for the Third, Fifth, Sixth, Seventh, Ninth, Tenth and Eleventh circuits; and to the U.S. Supreme Court. Law & Politics Magazine has selected him as a Washington Super Lawyer seven times. Mr. Ehlke has been selected three times as a Top 100 Trial Lawyers: Washington. GENA M. BOMOTTI is an attorney in the labor and Employment Practice Group at the law firm of Riddell Williams P.S. Ms. Bomotti has experience advising clients on a wide range of labor and employment issues, including compliance with federal and state anti-discrimination and harassment laws, wage/hour compliance, the Family and Medical Leave Act, the Americans with Disabilities Act, the Washington Industrial Safety and Health Act, the National Labor Relations Act, unfair competition, and trade secrets laws. She regularly drafts and reviews employment policies and other employment-related documents. As a litigator, Ms. Bomotti has represented clients in disputes involving discrimination, retaliation, workplace health and safety, and wage and hour issues. Her litigation experience also includes representing clients in alternative dispute resolution forums, such as mediation. Ms. Bomotti received her B.A. degree, cum laude, in speech communication from the University of Washington and spent a year abroad in Montpellier, France, and is proficient in French. She earned her J.D. degree, summa cum laude, from Seattle University School of Law. While in law school, Ms. Bomotti served as managing editor the The Seattle Journal for Social Justice, president of the Labor & Employment Law Association, and was a teaching assistant for civil procedure. She is a member of the Washington State and King County bar associations and the Washington Women Lawyers. MAGGIE LELAND is the Legislative and Laboratory Programs Manager for the Division of Occupational Safety and Health, Washington Department of Labor and Industries. In this position, she oversees and manages DOSH's legislative activities, analyzes the impacts of potential legislation, responds to legislative inquiries, researches issues, and develops legislative proposals. Ms. Leland manages the accredited Industrial Hygiene Laboratory and she coordinates and manages stakeholder groups. Prior to joining DOSH, she was an Assistant Attorney General with the Washington State Attorney General's Office, Labor and Industries Division as a program advisor. Ms. Leland conducted litigation at all levels, including the Court of Appeals, and was the primary client contact for advice on complex legal issues related to compliance, rulemaking, policy issues, and public disclosure. She was a recipient of the Attorney General's Office Excellence Award in 2008. In addition, Ms. Leland has more than 12 years experience as an occupational health and safety professional working in both the private and public sector. She earned her J.D. degree from Seattle University and her M.S. degree from San Diego State University. Ms. Leland is a member of the Washington State Bar Association. DEREK MOORE is an attorney with Bishop Law Offices, P.S., whose practice includes representing injured workers in third party claims arising from accidents at construction sites and other workplaces. They recently prevailed on appeal in Afoa v. Port of Seattle, 160 Wn. App. 234, 247 P.3d 482 (Div. 1, 2011), in which a worker alleges he was paralyzed as a result of WISHA violations of his direct employer, over whom the Port retained control. The Port appealed and this case is currently pending before the Supreme Court of Washington. Mr. Moore earned his B.A. degree from the University of Florida, his M.B.A. degree from Rollins College and his J.D. degree, magna cum laude, from Seattle University School of Law in 2006. He is admitted to practice in Washington, and before the U.S. District Court for the Western District of Washington, and is an EAGLE member of the Washington State Association for Justice. Prior to law school, Mr. Moore worked as an insurance adjuster and claims investigator for a wide range of property and casualty claims including bodily injury, wrongful death, premises liability, product liability, and builders' risk as well as property damage appraisals of automobiles and of residential and commercial structures. RALPH C. POND joined Aiken, St. Louis & Siljeg, P.S. in 2009 after nearly 25 years with Lane Powell PC, where he served as chair of the firm's labor and employment practice group, and more than three years as a principal with Benedict Garratt Pond & Pierce, PLLC. His practice includes counseling and representing both management and aggrieved employees in trial and appeal of employment discrimination, non-competition, labor, wrongful discharge, ERISA, FMLA, wage/hour (including class actions), Sarbanes/Oxley, worker's compensation and OSHA/WISHA matters. Mr. Pond is the featured expert in the nationally recognized interactive training program entitled "The ADA and Disability Law." In more than 29 years of practice, he has successfully pursued and defended hundreds of employment claims involving public and private employers before federal and state courts and agencies. Mr. Pond also has obtained favorable decisions in a number of significant employment cases before state and federal appellate courts in Washington. He is regularly engaged to speak at local and regional labor and employment law education seminars.
