DAVID R. COOPER is an attorney with Kenlan Schwiebert Facey & Goss, P.C., where his main areas of practice are business transactions and commercial law, energy and utility law, land use law, municipal law, real estate law, and telecommunications. He is a member of the State Bar of Texas and Vermont Bar Association. Mr. Cooper is admitted to practice in Massachusetts and before the U.S. District Court, District of Massachusetts. He earned his B.A. degree, cum laude, from Pomona College and his J.D. degree, with honors, from the University of Texas School of Law. DAVID L. GRAYCK is a shareholder in the Montpelier law firm of Cheney, Brock & Saudek, P.C. His practice is exclusively focused on land use permitting and litigation, where he represents developers, municipalities and project opponents. Mr. Grayck routinely appears before the Act 250 district environmental commissions, development review boards and the Environmental Court. He has previously served as general counsel for the Vermont Environmental Board and Vermont Water Resources Board, and is a former deputy Vermont secretary of state. Mr. Grayck was a featured speaker at the New York State Association of Professional Land Surveyor's 52nd Annual Conference, where he lectured on land use and subdivision law, and expert testimony and evidence law. He is admitted to practice in Vermont and New Hampshire and is a member of the American and Vermont bar associations. Mr. Grayck earned his B.A. degree, with highest honors, from Marlboro College and his J.D. degree from Boston University. KANE H. SMART brings a strong background in environmental law and natural resource management to his position as an associate in Downs Rachlin Martin PLLC's Energy and Telecommunications Group. His education in the natural sciences, as well as his professional experience with both the regulated community and government, provide valuable perspective as he assists clients in a variety of environmental matters. After receiving his J.D. degree from Vermont Law School in 2009, Mr. Smart completed a clerkship for Judge Thomas Durkin at the Vermont Environmental Court, where he worked extensively on land use issues, focusing heavily on appeals from municipal zoning boards and Act 250 District Commissions. As a summer law clerk with the Environmental Enforcement Section of the U.S. Department of Justice, in Washington, D.C., he gained practical knowledge about the litigation of federal environmental laws, including CERCLA and the Clean Air Act. Mr.Smart earned his B.S. degree, summa cum laude, from Northland College; his J.D. degree, magna cum laude, and his M.S. degree, cum laude, from Vermont Law School. As a student at Vermont Law School, Mr. Smart served as an editor on the Vermont Law Review. He also was a member of the Moot Court Appellate Board and a quarterfinalist in the 2009 National Environmental Law Moot Court Competition. He earned academic excellence awards for the highest grade in five subject areas, including appellate advocacy and scientific controversies. His concentrated studies in ecosystem management, habitat sampling and statistical analysis provide a rich background for understanding the environmental aspects of clients' goals. Prior to attending law school, he worked as an environmental management specialist for a global hydraulic manufacturing company where he championed the design and implementation of an ISO:14001-certified environmental management system to manage the company's environmental impacts. He assisted in improving the company's bottom line and environmental performance by creating an action plan and internal audit methodology to ensure compliance, meet goals and minimize risks.
