DAN C. DARGENE is a shareholder with Ogletree Deakins in Dallas. His areas of practice include employment law, litigation, employee unfair competition, and trade secrets. Mr. Dargene has litigated nearly 50 cases, and tried several cases to administrative law judges for the Department of Labor and the National Labor Relations Board. He represents employers in a variety of industries, including utilities, oil and gas, retail, manufacturing, hospitality, and health care. He is one of only 25 attorneys in Texas who is board certified in both civil trial law and in labor and employment law. He has litigated complex business, employment, personal injury and insurance disputes throughout the country and tried cases to a jury verdict in four states. He has represented clients in disputes arising in Brazil, Canada, England, Mexico, The Netherlands, Scotland, Qatar and throughout the U.S. Mr. Dunn represents corporations, insurance carriers and individuals in a variety of complex matters involving business disputes, employment law, partnership issues, FINRA, arbitration, class actions, shareholder oppression, breach of contract, "business divorce," non-competes, trade secrets, whistleblowing, and significant personal injuries. He is an adjunct professor at Southern Methodist University's MBA program. JOSHUA J. IACUONE is an attorney with Clouse Dunn LLP, where he represents a variety of clients in employment, personal injury, and business litigation cases on both sides of the docket. His employment practice includes working with clients on all types of employment discrimination cases, as well as non-compete and executive compensation disputes. Mr. Iacuone also handles trade secret matters, and has obtained and defeated temporary restraining orders and injunctive relief concerning departing employees. Mr. Iacuone's business litigation experience ranges from handling contractual disputes for clients in a number of industries, including online dating services and a preeminent lighting manufacturer, as well as handling cases involving various business torts. He is a member of the State Bar of Texas and all federal districts courts in Texas. Mr. Iacuone earned his B.A. degree, cum laude, from Texas Tech University; and his J.D. degree, cum laude, from Southern Methodist University, Dedman School of Law (SMU Law Review, Jackson Walker First-Year Moot Court Champion). JAMES J.S. JOHNSON is a Texas lawyer practicing solo in Dallas, where he also practices non-profit law as a special counsel. His main areas of practice include education law, contracts, exempt property issues, debtor-creditor/bankruptcy law, and civil rights law. Mr. Johnson is licensed to practice in the states of Texas and Colorado. Mr. Johnson earned his B.A. degree from Wake Forest University and his J.D. degree from the University of North Carolina at Chapel Hill. He is an independent hearing examiner certified by the Texas Education Agency, and a paternity establishment entity certified by the Texas Attorney General's office. Mr. Johnson teaches as an adjunct at three Texas colleges. He also writes and teaches political history on cruise ships. Mr. Johnson is a member of the Colorado Bar Association, the National Association of Subrogation Professionals, and the Texas Bar Association. JOHN D. SMART is a shareholder in the Dallas law firm of Winstead P.C. He has extensive first-chair experience in the defense of claims under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans With Disabilities Act, the Fair Labor Standards Act, the Occupational Safety and Health Act, and the National Labor Relations Act. He also handles all forms of common law employment claims, including actions for unfair competition, violations of noncompetition and employment agreements, and claims for defamation and tortuous interference with contract. Mr. Smart also devotes a significant amount of time to human resources counseling, negotiation and drafting of employment and severance agreements, and the preparation and review of employee handbooks and personnel policies. Mr. Smart devotes his practice to the representation of management in traditional labor, employment and immigration law matters and is board certified by the Texas Board of Legal Specialization. He has lectured on "Employing the Foreign Worker," "Preventing Sexual Harassment and Retaliation Claims,""Dealing with Leaves of Absence Under the FMLA, ADA and Workers' Compensation Act," and "Preventing Wrongful Discharge Lawsuits."
