TODD M. GALANTE heads the bankruptcy and creditors' rights team in the LeClairRyan Newark, New Jersey office. As a shareholder with the law firm, Mr. Galante practices primarily in the areas of bankruptcy, insolvency, business and loans workouts, foreclosure, subprime mortgage and lender liability litigation, collection, fraud and franchise litigation, trademark and unfair trade practices, general equity, partnership and corporate litigation, as well as other complex commercial litigation. He is a certified arbitrator and mediator, handling private civil matters, as well as those conducted through the Superior Court of New Jersey arbitration and mediation programs. Mr. Galante has been a speaker for National Business Institute and other organizations. He recently presented a lecture regarding the subprime mortgage crisis and related litigation, and has published a number of articles on various litigation topics. Mr. Galante has been listed in The Best Lawyers in America (bankruptcy and creditor-debtor rights law), New Jersey Monthly Magazine's Super Lawyer Section, New York Magazine - New York Area's Top Lawyers, Corporate Counsel - Top Lawyers (bankruptcy and creditor-debtor rights law) and a member of the Million Dollar Advocates Forum. He also served as an adjunct professor at Seton Hall University School of Law, teaching bankruptcy law. Mr. Galante earned his B.A. degree, cum laude, from Rutgers University and his J.D. degree from Seton Hall University School of Law. He is a member of the American Bar Association; the New Jersey State Bar Association; the American Trial Lawyers Association (Commercial Law and Bankruptcy Law Committees); and the American Bankruptcy Institute. Mr. Galante is a member of the bars of the U.S. Supreme Court; U.S. courts for the districts of New Jersey; Southern, Eastern and Northern districts of New York; Eastern District of Wisconsin; U.S. Court of Appeals for the 3rd Circuit District of Columbia; and the District of Columbia. He also served as law clerk to the late Vincent J. Commisa, Chief Judge of the U.S. Bankruptcy Court for the District of New Jersey (1986-1987). ROBERT B. NUSSBAUM is of counsel with Saiber LLC, where he practices in general commercial litigation and appears regularly in New Jersey's federal and state courts. A significant portion of his practice involves the handling of construction-related matters for owners, contractors and suppliers, as well as the defense of personal injury and product liability actions. Mr. Nussbaum has defended clients in several complex pieces of construction litigation and has also defended wrongful death actions, numerous premises liability cases for major hotel chains and insurance companies, motor vehicle accident claims, and product liability actions brought against manufacturers and distributors of industrial equipment and commercial products. He also practices extensively in the area of collections. Mr. Nussbaum earned his B.A. degree from the University of Pennsylvania and his J.D. degree from Seton Hall University. He is a frequent author and lecturer in his areas of expertise. Mr. Nussbaum is a member of the Essex County, New Jersey State and American bar associations, and the Defense Research Institute. DAVID W. PHILLIPS is a shareholder with LeClairRyan. Mr. Phillips is an experienced trial lawyer, practicing litigation for more than 25 years in the state and federal courts in New York, New Jersey and Pennsylvania. He litigates trademark and unfair competition claims, contract and UCC claims, franchise litigations, chancery claims, lender liability defense, real property disputes, and adversary proceedings in bankruptcy court. Mr. Phillips has extensive experience representing lenders in recovery of funds and in defense of lender liability actions, and in handling whistle blower actions, harassment actions, corporate dissolutions, shareholder rights actions, fraud and RICO actions, and seeking and defending emergent reliefs. He is admitted to practice in the state and federal courts of New York and New Jersey, and the 2nd and 3rd Circuit Courts of Appeal. Mr. Phillips is a member of the New Jersey State Bar Association, New York State Bar Association, District of Columbia Bar and American Bar Association. He earned his B.A. degree from Wilkes University and his J.D. degree from Temple University School of Law.
