JON R. BRAKKE is a partner in the Vogel Law Firm in Fargo. His practice centers principally on creditor and debtor representation in the U.S. Bankruptcy Court for the districts of North Dakota and Minnesota, commercial and collection litigation, and business and corporate matters. Mr. Brakke is a frequent lecturer on bankruptcy and commercial matters. He earned his B.A. degree from Northwestern University and his J.D. degree, cum laude, from the University of Minnesota. Mr. Brakke is a member of the Cass County, Minnesota State (member, Bankruptcy Law Section) and American bar associations, and the State Bar Association of North Dakota. JOHN S. FOSTER is the president of the law firm of Zimney Foster P.C. in Grand Forks, where his practice is devoted to banking law, commercial transactions and creditors' rights in bankruptcy. He earned his B.A. degree, cum laude, from the University of Wisconsin and his J.D. degree, with distinction, from the University of North Dakota School of Law. Mr. Foster also is Special Assistant Attorney General for North Dakota Mill & Elevator Association, and a former Assistant States Attorney for Grand Forks County. He is an adjunct faculty member of the University of North Dakota School of Law, where he teaches debtor/creditor law, bankruptcy law, commercial paper and advanced commercial transactions, and has lectured on Uniform Commercial Code, bankruptcy and creditors' rights issues for lawyer and bankers associations. Mr. Foster also serves as faculty on the Dakota School of Banking sponsored by North Dakota Bankers Association. He is the recipient of the American Jurisprudence Award for Excellence in Commercial Transactions; a recipient of the Supreme Court Justice Nels Johnson for Achievement in the Study of Secured Transactions; and is listed in The Best Lawyers In America and Chambers USA: America's Leading Business Lawyers . Mr. Foster also has served as a director of a national bank. He is the author of four textbooks, Debtor/Creditor Law , Bankruptcy, Commercial Paper & Payment Systems , and Advanced Commercial Transactions (Barnes & Noble UND publishing); and has published in the North Dakota Law Review . Mr. Foster also has written numerous seminar texts on topics such as UCC Revised Article 9, workout agreements, check fraud, bankruptcy, agricultural liens, personal guaranty law, judgment collection, foreclosure issues, prejudgment remedies and commercial loan documentation. TRACY KENNEDY is a shareholder and director of the law firm of Zimney Foster P.C. in Grand Forks, where her practice is devoted to banking law, commercial and business law, creditors' rights, and agricultural lending and credit transactions. She is an adjunct faculty member at the University of North Dakota School of Law, where she is teaching UCC Article 9 Secured Transactions. Ms. Kennedy co-wrote with John Foster a UCC Article 9 textbook (Barnes & Noble UND publishing). She has presented seminars to various legal and lending organizations in commercial topics, such as loan documentation, UCC, loan workouts, agricultural liens, collection law, foreclosures and bankruptcy. Ms. Kennedy served as president of the Grand Forks County Bar Association, 2004 to 2005. She earned her B.A. degree from Minot State University and her J.D. degree from the University of North Dakota School of Law. Ms. Kennedy served as an associate editor of the North Dakota Law Review . She practices in North Dakota and Minnesota state courts, and before the U.S. District Court for the state of North Dakota and the U.S. Court of Appeals for the 8th Circuit. ROGER J. MINCH is the principal of Serkland Law Firm, A Professional Corporation, in Fargo. He practices in the areas of creditors' rights in bankruptcy, agricultural law, commercial litigation, secured transactions, leasing, loan documentation, workouts, collections and foreclosures. Mr. Minch is a certified creditors' rights specialist. He has spoken for numerous continuing legal education programs for the State Bar Association of North Dakota, the Minnesota State Bar Association, banking and credit union associations and private producers of continuing legal education programs. Mr. Minch earned his B.A. degree from North Dakota State University and his J.D. degree from the University of North Dakota. He is a member of the Cass County and Minnesota State (member, Bankruptcy Section) bar associations, the State Bar Association of North Dakota (member, Local Bankruptcy Rules Committee and Mediation and Arbitration Committee), the American Bankruptcy Institute and the Commercial Law League of America.
