AMY J. ADOLAY is a partner at the law firm of Krieg Devault LLP. Ms. Adolay concentrates her practice in the areas of employment law and litigation. She represents employers of all sizes in all aspects of employment law. Ms. Adolay devotes much of her practice to daily human resources issues that arise for employers, as well as advising clients concerning federal and state employment laws, changes to those laws, and how those laws affect employers' business practices and policies. Ms. Adolay also handles EEOC and similar administrative charges for employers as well as the defense of employment law claims such as sexual harassment, discrimination, retaliation, wage and hour, and other employment claims. She has represented both employers and employees with respect to the drafting, negotiation and enforcement of employment agreements, including non competition provisions. Her non-employment law litigation practice generally focuses on breach of contract actions and other business litigation matters. Ms. Adolay earned her B.A. degree, cum laude, in political science from Miami University, Oxford, Ohio and her J.D. degree, cum laude, from Indiana University School of Law, Indianapolis, Indiana. She was a panel speaker for the Indianapolis SHRM meeting in 2010 and has lectured on several topics including "Essentials of Record Retention and Legal Holds," and "Terminations and Layoffs - Avoiding Liability." Ms. Adolay is a member of the Hamilton County, Indiana State and American bar associations. DANUTA BEMBENISTA PANICH is a shareholder at the law firm of Ogletree, Deakins, Nash, Smoak, & Stewart, P.C. Ms. Panich has dealt with all aspects of labor and employment law. Since 1995, she has focused primarily on defending employers, including many of the nation's largest companies, in class actions, multi-plaintiff and collective actions, pattern and practice claims, and other "bet the company" matters such as investigations of catastrophic industrial accidents. Ms. Panich frequently speaks and provides training for professional, bar and trade associations, law schools, CLE providers and employers on litigation techniques, electronic discovery and records management, as well as various employment related issues such as wage-hour, harassment, diversity, and occupational safety and health. She has written several articles on these topics, and is active, through her leadership role in the Federal Bar Association, in developing continuing legal education programs for practitioners and their clients. She is a member of the Federal Bar Association (officer and member of the Labor & Employment Law Section; Section Chair 2005-2007; current treasurer); American, Illinois State and Indiana State bar associations; Society for Human Resources Management (SHRM); Society for Human Resources Management of Northwest Indiana; National Advocates Society, and the National Association of Professional Women. Ms. Panich is also a fellow of the Federal Bar Association and was honored as the Section Leader of the Year in 2007. She was the recipient of the Excellence in Public Interest Service Award, U.S. District Court for the Northern District of Illinois and Federal Bar Association in 2006 and was listed in the Bar Register of Preeminent Women Lawyers in the 2011 Inaugural Edition. DAVID J. CARR is a partner in the Labor and Employment Group of Ice Miller LLP, and the chair of the Employment Litigation Group. Mr. Carr focuses his practice in the areas of personnel policies, employment discrimination, wage and hour law and employment contracts involving trade secrets, confidential information and covenants against competition. He is a veteran labor negotiator and has handled numerous labor arbitrations, union avoidance and other collective bargaining matters. Mr. Carr also possesses substantial experience representing employers in wrongful discharge lawsuits and employment discrimination investigations, including sexual harassment situations, as well as litigation of class and collective actions under the Fair Labor Standards Act, in addition to federal and state jury trials. He earned his B.A. degree, summa cum laude, from DePauw University and his J.D. degree from Georgetown University Law Center. Mr. Carr has several publications including "The Development of Employment Rights and Responsibilities from 1985 to 2010," American Bar Association Journal of Labor and Employment Law . He is a frequent lecturer on labor and employment issues and spoke at the American Bar Association Labor Section CLE seminar in Washington, D.C. in 2009. Mr. Carr is a member of the American Bar Association (Labor Section Committee on Individual Rights and Responsibilities in Workplace; co-chair, Non-Compete and Trades Secrets Sub-Committee); Indianapolis Bar Association (former chair, Labor Law Section); Indiana Bar Association, Christian Legal Society, and Federalist Society. MICHAEL CORK is a partner in the law office of Bamberger, Foreman, Oswald & Hahn, LLP, in Indianapolis. Mr. Cork concentrates his practice in the areas of employment-related matters, employment litigation, commercial litigation, constitutional litigation, and corporate legal matters. In addition, he has litigated employment issues under Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Equal Pay Act, the Fair Labor Standards Act, and the Employee Retirement Income Security Act. MICKEY J. LEE is an attorney in the law firm of Stewart & Irwin PC, in Indianapolis. Mr. Lee is a litigator, practicing in the area of labor and employment, insurance defense, construction litigation, worker's compensation and small business representation. He has represented clients in state courts in Indiana and federal courts throughout the entire Midwest. He has also represented clients before state and federal agencies, including the Worker's Compensation board of Indiana, the Indiana Civil Rights Commission, the Merit System Protection Board and the Equal Employment Opportunity Commission. Mr. Lee earned his B.S. degree from Indiana University - Bloomington and his J.D. degree from Indiana University - Indianapolis. DAVID J. PRYZBYLSKI is an attorney in the law firm of Barnes & Thornburg LLP, in Indianapolis. Mr. Pryzbylski is a member of the firm's Labor & Employment Department. He regularly defends employers in employment matters alleging wrongful discharge, discrimination, retaliation, sexual harassment, breach of contract, and other employment-related claims, including the classification of workers as independent contractors under various state and federal laws. Mr. Pryzbylski has had the opportunity to litigate the classification of workers as independent contractors in various states around the country.
