DONALD E. HEMKE is a shareholder with Carlton Fields in Tampa, where his experience includes zoning/land use/environmental, governmental and construction litigation. Prior to joining Carlton Fields, he served as a law clerk for Hon. John W. Peck of the 6th U.S. Court of Appeals. Mr. Hemke has tried land use/zoning cases, including Section 1983 civil rights cases, for landowners in federal court. In addition to litigation, he often is involved in obtaining government permits and licenses. Mr. Hemke also has represented owners, suppliers, contractors and subcontractors in construction cases involving delay, inefficiency, hindrance and differing site condition claims. He speaks and writes frequently on zoning and construction law. Mr. Hemke is a member of the American and Hillsborough County bar associations and The Florida Bar. He has served as an arbitrator for the U.S. District Court for the Middle District of Florida and the American Arbitration Association. Mr. Hemke earned his B.A. degree, cum laude, from Vanderbilt University and his J.D. degree from the University of Virginia Law School. S. BRENT SPAIN is a partner with Theriaque & Spain, where he practices primarily in the areas of land use, local government and administrative law, with an emphasis on land use litigation and appellate advocacy. He currently represents private individuals, developers, and local governments in various land use and zoning matters throughout Florida. Mr. Spain is a frequent lecturer on land use related topics and has written several land use related articles. He earned his B.A. degree from the University of California-Davis and his J.D. degree, magna cum laude, from Florida State University. Prior to entering private practice, Mr. Spain served as a judicial law clerk for Justice Harry Lee Anstead of the Florida Supreme Court. He is a member of The Florida Bar and the State Bar of California. ROBERT J. STANZ is managing partner of the Law Offices of Robert J. Stanz, P.A., where he practices in the area of real property law, with special emphasis on land use and development, as well as both commercial and residential transactions and litigation. He has significant experience with retail leasing, zoning and land development regulations. Mr. Stanz has considerable experience regarding the permitting, purchase, sale and leasing of communications towers, as well as Florida timeshare law and property owners' associations. He is a member of the Kentucky Bar Association, the Indiana State Bar Association, the American Bar Association, The Florida Bar, the Polk County Builders Association, the Florida Home Builders Association, the Florida Green Building Coalition and the Polk Area Real Estate Council. He is admitted to practice in Florida, Kentucky and Indiana. Mr. Stanz earned his B.S., magna cum laude, and his M.S. degrees from the University of Louisville and his J.D. degree from the Louis D. Brandeis School of Law at the University of Louisville.
