ROLF G. ASPHAUG is the deputy general counsel for the Denver Regional Transportation District. Mr. Asphaug manages seven attorneys and support staff, and directly handles workers' compensation hearings; personal injury and other civil litigation; unfair labor practice hearings; labor grievance and interest arbitrations; and employment and civil rights litigation. He also works on contracts, real property agreements, intergovernmental agreements, collective bargaining, employee benefits and policies, ADA accessibility issues, and first amendment issues. Mr. Asphaug successfully represented RTD in its most recent collective bargaining interest arbitration, and recently drafted RTD's IGA with Denver International Airport for commuter rail to DIA. He has authored many of RTD's existing policies, including ethics, drug and alcohol, and records retention and inspection policies. Mr. Asphaug has trained RTD management and board members in ethics and civil rights, and has previously spoken at CDLA, CBA and American Public Transportation Association conferences. Before joining RTD in 1989, he was an associate with Baker Botts in Houston and the Sierra Club (now Earthjustice) Legal Defense Fund in Denver. Mr. Asphaug has a bachelor's degree, with honors, from Rice University and a law degree from Columbia University. He is also a past president of the Colorado Mountain Club, a founding board member of the Colorado Fourteeners Initiative, and he currently volunteers with the Colorado Mountain Club and Cub Scouts. ROBERT G. COLE is an attorney with the law firm Collins Cockrel & Cole, where his practice focuses on all areas of local government law, with an emphasis on general counsel representation of municipalities and special districts. Mr. Cole is the town attorney for Gypsum and Pagosa Springs, Colorado and general counsel for the Centennial Urban Renewal Authority; Castle Rock Downtown Development Authority; and numerous special districts and local government authorities, with a considerable emphasis on fire and ambulance service providers and emergency communications and E-911 authorities. Throughout his legal career, he has also provided legal counsel to his clients regarding water rights and water supply development, public lands, and environmental issues. Mr. Cole is an active speaker on general local government and emergency services issues. He is a member of the Denver, Colorado and American bar associations and Metro City Attorneys Association. Mr. Cole earned his Bachelor of Science degree from Oklahoma State University and his Juris Doctorate degree from the University of Colorado. GERALD E. DAHL is a partner of the Denver firm Murray Dahl Kuechenmeister & Renaud LLP. He serves as town attorney for Silverthorne and city attorney for Wheat Ridge, Colorado. Mr. Dahl's practice in local government and land use law is statewide. He is a past general counsel to the Colorado Municipal League and the Northwest Colorado Council of Governments. THOMAS J. LYONS is a member of the law firm of Hall & Evans LLC, where his practice involves handling claims before governmental agencies on behalf of regulated and licensed businesses and professionals, including healthcare, insurance and accountancy issues. Additionally, his background in legislative drafting and analysis at the state and federal levels allows him to offer assistance to groups and businesses faced with proposed statutory changes and regulations. Mr. Lyons's litigation practice emphasizes the defense of federal civil rights and discrimination matters, employment contract and related disputes, and a variety of claims brought against Colorado's public entities. These responsibilities have led to multiple jury trials in both state and federal courts. He is admitted to practice in Colorado and before the U.S. District Court, District of Colorado and the U.S. Court of Appeals, Tenth Circuit. Mr. Lyons earned his J.D. degree from the University of Colorado School of Law and his B.A. degree, cum laude, from Claremont McKenna College. He is a member of the Denver, Colorado and American bar associations; Faculty of Federal Advocates; Defense Research Institute; and Colorado Defense Lawyers Association. JOSH A. MARKS is a partner in the Boulder law firm of Berg Hill Greenleaf & Ruscitti LLP, where he focuses on employment litigation; civil rights and discrimination claims; and public entity work, including law enforcement and land-use litigation. He has litigated a wide range of employment related issues for both private and public sector clients involving discrimination claims based on race, sex, age, national origin, handicap, property, liberty, and free speech claims under 42 U.S.C. 1983; overtime claims under the Fair Labor Standards Act; retaliatory discharge claims under ERISA; and various contract and tort claims. Mr. Marks is frequently retained to defend law enforcement and jail personnel in civil rights suits involving false arrest, excessive force and conditions of confinement claims. He has developed considerable expertise in defending constitutional takings, inverse condemnation, judicial review, and other state and federal challenges of land-use decisions and ordinances by public entities. Using a risk management approach to public entity matters, Mr. Marks frequently provides training to police and sheriffs' organizations on civil liability and employment issues, and to county commissioners on land use issues. He is admitted to practice in Colorado and before the U.S. District Court, District of Colorado and the U.S. Court of Appeals, 10th Circuit. He earned his J.D. degree from the University of Colorado School of Law and his B.A. degree, with honors, in history and environmental studies from the University of California at Santa Barbara. HERBERT C. PHILLIPS is of counsel with the law firm Hayes, Phillips, Hoffmann & Carberry, P.C., where his practice emphasis is municipal, real estate, general business and litigation. He was a city attorney for Northglenn, Colorado (1981); town attorney, Alma, Colorado (1993); city attorney, Greenwood Village, Colorado (1997); city attorney, Cripple Creek, Colorado (2000); city attorney, Fairplay, Colorado (2007); general counsel for the Metropolitan Denver Water Authority; and special counsel to cities of Aurora, Golden, Federal Heights, Commerce City, Superior, and Westminster, Colorado. Mr. Phillips is a member of the Denver and Colorado bar associations (chairman; Local Government Committee, 1987).
