MARK A. BREGMAN is managing partner in the Scottsdale law firm of Bregman Burt Feldman Attorneys & Counselors at Law. His areas of practice include estate and asset protection planning, probate and trust administration and litigation, and related special situations involving real estate and business transactions. Mr. Bregman frequently lectures to various professional groups on topics pertaining to his areas of practice. He has published "Charitable Remainder Trusts: How Many Objectives Can One Strategy Satisfy," May/June 2001, Planned Giving, the newsletter of the Arizona Community Foundation, and an article on the changes to individual retirement accounts in the Maricopa Lawyer (2002). Mr. Bregman is a former superior court pro tempore (civil and family courts). He earned his B.A. degree from Virginia Tech and his J.D. degree from Arizona State University. Mr. Bregman is a member of the Scottsdale Bar Association (past president, past director) and the State Bar of Arizona (member, Fee Arbitration Committee). He was a lead attorney in In real estate of Pilafas , 172 Ariz. 207, 836 P.2d 420 (1992) which distinguishes the revocation of living trusts and wills. He also was the attorney in the recent bankruptcy case, Gaughan v. The Edward Dittlof Revocable Trust, et al (In re Costas, 346 B.R. 198 (2006); presently on appeal to the 9th Circuit Court of Appeals; pre-petition disclaimers effective in bankruptcy cases. He has recently presented seminars on the following topics: Preparing 706 Estate, Gift, and Generation Skipping Tax Returns, Drafting Effective Arizona Trusts, Estate Planning and Recovery for Elderly Clients, Protecting Personal Assets and Minimizing Estate Taxes at Death, Disclaimers and Arizona Probate. KEITH R. LYMAN joined the law firm of Frazer Ryan Goldberg & Arnold LLP, in 2008. As an estate planning attorney, Mr. Lyman focuses his practice on estate planning and long-term care planning, including Medicaid eligibility and asset protection, along with the use of special needs trusts. He also is a certified financial planner, having earned his designation in 1996. Mr. Lyman practiced law in Indiana for 27 years with a practice focused on estate planning and long-term care planning. He graduated from Washburn University School of Law in 1977, and is licensed to practice law in Kansas, Indiana and Arizona. He also is a member in good standing of the Arizona State Bar Association and the National Association of Elder Law Attorneys. PHOEBE MOFFATT is a sole practitioner in Tempe, Arizona, certified as a specialist in estate and trust law by the State Bar of Arizona. Ms. Moffatt focuses her legal practice in the areas of estate planning; trust administration; preparation of estate and gift tax returns; administration of decedent's assets with/without probate; legal counsel for beneficiaries; representation in guardianship/conservatorship matters; and representation on small business formation matters. She is currently a member of the Valley Estate Planners, the East Valley Estate Planning Council, the Arizona Women Lawyers Association, and the Probate and Trust Law Section of the State Bar of Arizona. After years of service on the State Bar YLD Executive Council, Ms. Moffatt was elected as the president of the State Bar Young Lawyers Division. She has also served as the chair of the Gift of Life Program sponsored jointly by the Maricopa County Bar YLD and the Donor Network of Arizona. Ms. Moffatt has spoken before the Phoenix Tax Workshop and the American Society of Women Accountants regarding trends in tax litigation. She earned her B.S. degree, magna cum laude, from Arizona State University and her J.D. degree, with Phi Kappa Phi honors, from the University of Memphis School of Law, where she was also a published staff writer for the University of Memphis Law Review.
